His initial consultation includes a client interview to find case background and history, review of paper title and Land registry docs with client, taking some simple site measurements, writing an Initial Assessment (illustrated with a sketch plan and photographs) stating opinion based on facts available as to likely position of boundary, and highlighting any areas of further research needed.
He will help the client to determine the boundary by using Registered Title Plans; Older Pre-registration Deeds; Historical and current Ordnance Survey mapping; Aerial Photographs and interpreting existing ground features. This will be presented as a fully CPR (Civil Procedure Rules) compliant report, which can be used in negotiations or as evidence in court.
Single Joint Expert is where both sides of the dispute agree to appoint the same expert. This avoids costs associated with having multiple experts involved. As an independent unbiased expert Expert has acted as a Single Joint Expert on numerous occasions.
An alternative approach to court proceedings is for the parties to agree to expert determination, whereby the expert determines the boundary line without the parties having to go to court.
