Automotive Collision Repair and Valuation Issues
ID: 725938
Texas, USA
Diminished Value is a concept concerning how the value of a vehicle is effected by the simple fact of having been repaired after a collision. Expert's extensive knowledge of repair issues and experience in insurance claims prepares him to comment clearly on this subject. Most of his reports, depositions and court appearances have resulted in findings favorable to his client.
Various diminished value claims where the client requires a substantiated opinion as to what, if any, value has been lost as a result of a collision and subsequent repairs. Most claims are resolved with a report, some with a deposition, and a minority have required court testimony. Most claims are resolved in client's favor.A Texas case required a detailed inspection of the repaired vehicle to determine if repairs had been performed properly according to vehicle manufacturer requirements and usual and customary practices. The case against the repair facility was found in favor of the repair facility. The case against the insurance carrier was resolved out of court.State Farm required testimony in Maryland to support the position that a vehicle had been improperly repaired as a result of inadequate diagnostic procedures at the beginning of the process. Decision in their favor after a model of the action of the collision forces was shown and explained to the judge. The owner of a motorcycle required evidence to support his claim that the repair facility failed to resolve a problem with the front suspension. Microscopic examination of the bearings and factory manual test procedures supported this claim and the case was settled out of court.
