Intellex Expert Witness Trend Radar – July 2026

Expert Witness Demand by the Numbers

The first half of 2026 has confirmed what we already suspected: expert witness demand is up, and it’s up broadly, not just one or two practice areas.

Global Market

The global expert witness services market is valued at roughly $0.82 billion in 2026 and is projected to reach $1.91 billion by 2035, growing at a CAGR of approximately 11%
(Business Research Insights, 2026). Corporations remain the leading end-user of these services, ahead of insurance companies (Verified Market Research, 2025). North America continues to be the leading region for expert witness demand.

Practice Areas

Construction and employment litigation remain the highest-volume practice areas for expert retention, but growth in newer areas such as cybersecurity and data breach litigation, trade secret disputes, and mass tort/product liability is narrowing the gap. Civil litigation alone accounts for more than half of all expert witness engagements.

Disciplines

Forensic financial experts remain the single largest category of expert retention, accounting for roughly 43% of market share, while medical expert witnesses are the fastest-growing segment by CAGR.

For a closer look at what’s driving each of these newer categories and which experts they demand, see our mid-year breakdown, Mid-Year Litigation Trends Requiring Experts in 2026.

Why This Matters for Case Strategy

Rising demand isn’t just a staffing statistic. It reflects how litigation itself is changing.

Cases have become more technical, discovery disputes increasingly turn on forensic and data-driven evidence, and courts are applying stricter standards to expert qualifications and methodology.

As a result, counsel is engaging experts earlier in the case timeline to both strengthen case strategy and to secure availability in high-demand specialties before calendars are filled.

What This Means for Counsel

The practical implication is straightforward: waiting until trial prep to identify experts is increasingly risky, particularly in specialties where qualified professionals are booking further out than in past years.

Defense teams that build expert relationships early and plan expert needs across their full docket rather than matter-by-matter are better positioned to move quickly when a new case demands specialized testimony.

Firms that source experts case-by-case tend to hit the same wall: fragmented searches across referrals, databases, and one-off recommendations mean no single partner has visibility into the full matter, urgency pushes teams toward the first available name rather than the best-qualified one, and last-minute searches carry premium pricing with far less negotiating leverage.

A coordinated bench, built before a matter demands it, avoids that scramble entirely. And when a case requires multiple experts, having them sourced through a single relationship keeps their opinions methodologically consistent, which can be critical given courts’ scrutiny of redundant or inconsistent expert testimony under Federal Rule of Evidence 403.
