Key to the understanding of patents is claim construction and due to his work as an expert in patent-related matters, Expert has a deep understanding of issues of claim construction. Data acquisition and digital signal processing have been incorporated into the majority of Expert’s research, product development and consulting efforts. Signal processing is a technology equally important to medical, acoustic and scientific instrumentation, all of which Expert has had extensive experience. Expert has extensively applied digital filtering, digital signal analysis and synthesis, and other forms of digital signal manipulation in his R&D and consulting efforts. In addition, signal processing has been involved in many of cases for which he has served as an expert.
Patent litigation invariably involves the evaluation of infringement issues related to the alleged infringing devices or methods. Expert’s facilities includes a laboratory where can evaluate devices and thus he can opine on infringement based on his own independent measurements and analyses as well as his review of design documentation and data. Due to his knowledge of analog and digital circuits, audio and RF and microwave technologies, and both hardware and software issues, Expert can opine on infringement regarding a wide a variety of electronic systems including medical instruments, communications systems, scientific instruments, and audio / consumer products.
Expert has worked on a variety of projects involving electroacoustics: sound measurement, hearing aids, assistive listening devices, noise dose measurement and audiometric test equipment. His interest in sound, hearing, and music developed early and is reflected in his academic work at MIT and in his many R&D and consulting efforts. He researched novel acoustic techniques as applicable toward various sorts of medical devices, both therapeutic and diagnostic, while employed in the Research Department of a medical instrument manufacturer.
Electronic system design has been Expert’s focus for his entire career. His hobby as an amateur radio operator since age 11, his education, and all of his work experience have involved electronic design. Expert has diverse R&D experience, having successfully developed systems combining a wide variety of technologies including acoustical, optical, radio frequency, and microwave components and sensors, as well as data acquisition, embedded firmware and microprocessor-based control and measurement technologies. His multidisciplinary approach to design has combined analog and digital circuitry and signal processing with various sensors resulting in unique and proprietary designs for medical devices, applications involving sound and hearing, and a variety of scientific instruments.
Expert has design, manufacturing and expert witness experience in infusion pump projects and worked for a major manufacturer of infusion pumps and vital signs measurement equipment for ten years. He has served as an expert witness in patent litigation, product failure and liability cases involving infusion and fluid delivery; and has experience with pumps for hospital use as well as pumps for personal use. Expert has worked in many specific technology areas relevant to infusion pumps, including: motor control, air-in-line detection, flow rate measurement, data communications, pressure measurement, and sensor signal processing.
Expert’s professional experience includes the development of many types of medical instrumentation. Projects have involved clinical thermometry, pulse oximetry, blood pressure measurement, infusion pumps for hospital and personal use, a system with implantable markers to aid surgeons in the treatment of cancer, instruments to assist in the fitting of hearing aids, measurement of noise exposure, tissue ablation and aspiration, and the determination of farm animal fertility. As an expert witness, Expert has opined on the design and use of various medical instruments, most notably infusion pumps, and has also opined regarding intellectual property matters associated with medical equipment. Having worked in the medical device industry, Expert has had experience with the FDA-regulated manufacturing and development environment and has also presented data to the FDA as part of a product recall.
