National Preparedness Month: Building a Disaster-Ready Expert Witness Strategy

September is National Preparedness Month. For insurance defense, construction defense, and coverage counsel, it’s a good time to ask a practical question: is your expert bench ready before the next hurricane, wildfire, or severe storm system generates a wave of claims?

Catastrophe litigation tends to arrive in clusters, on compressed timelines. It rewards counsel and adjusters who have already identified the right experts, rather than those scrambling to find them once claims start coming in.

Why Disaster Season Puts Expert Testimony at the Center of the Claim

Disaster claims rarely turn on one obvious fact. Was the roof damage caused by the storm, or by pre-existing wear excluded under the policy? Did a covered wind event cause the loss, or did flooding, often subject to separate coverage, do the damage? Did a construction defect predate the storm, or did the storm just expose a defect that was already there?

These are technical, fact-intensive questions. Courts and arbitrators typically need a qualified expert to answer them credibly.

That makes expert selection a strategic decision, not an afterthought. The right expert can frame causation and scope of damage in terms a fact-finder can follow. The wrong one, or a late one, can leave a well-reasoned coverage position without the technical backing it needs to hold up.

The Expert Bench Disaster Claims Require

Disaster and catastrophe claims typically draw on several disciplines, each answering a different piece of the puzzle:

  • Cause & origin investigators determine what actually caused a loss, whether storm, fire, or water intrusion, and whether it falls within the policy’s covered perils.

  • Structural & civil engineers assess building damage, evaluate structural integrity, and opine on whether repairs (or a full rebuild) are warranted.

  • Forensic meteorologists reconstruct the specific weather conditions at a property at a given time, including wind speeds, hail size, and rainfall totals, to establish or rebut a causal link between a weather event and the claimed damage.

  • Construction defect & delay analysts evaluate post-storm repair work, contractor performance, and project scheduling when a rebuild becomes its own dispute.

  • Property damage & valuation experts quantify the scope and cost of loss, replacement value, and business interruption exposure.

Why These Cases Rarely Need Just One Expert

Causation, scope of damage, and valuation are separate technical questions. A single disaster claim often calls for more than one expert working in parallel: a meteorologist to establish the weather event, an engineer to tie that event to the physical damage, and a valuation expert to quantify the loss.

Treating expert sourcing as a portfolio need, rather than a series of one-off hires, tends to produce a more coherent, better-supported position at hearing or trial. Disaster claims are almost always the kind of matter where that adds up.

Preparing Your Bench Before the Claim Hits

Firms and carriers that handle recurring catastrophe exposure benefit from building expert relationships ahead of peak season, not during it. When a named storm or wildfire event generates a spike in claims, the attorneys and adjusters who already have vetted cause & origin investigators, engineers, and meteorologists on call are the ones who can move quickly without compromising on credentials or availability.
